Issue: Did the union’s amended complaint state a cause of action for employer domination or assistance of a union?

The union filed a complaint alleging employer interference, domination or assistance of a union, and refusal to bargain. A deficiency notice found causes of action for interference and refusal to bargain, but no cause of action for domination/assistance of a union. The union filed an amended complaint. The facts alleging domination/assistance were solely related to the interference and refusal to bargain allegations. The complaint and amended complaint did not state a cause of action for employer intentions to involve itself with internal union affairs and finances, or for employer attempts to create, fund, or control a company union. City of Anacortes, Decision 6863 (PECB, 1999). The Unfair Labor Practice Manager dismissed the domination/assistance allegation.
