Issue: Should the Executive Director accept the stipulations made by the parties to exclude the Fire Marshal as a confidential employee and amend the certification to accurately reflect the bargaining unit description?
Nothing has come to the attention of the Commission staff or the Executive Director that calls into question removal of the Fire Marshal as a confidential employee. Review of the parties stipulations show the duties of the Fire Marshal meet the Commission’s labor nexus test, therefore, the certification shall be amended to accurately reflect the unit description after removal of the Fire Marshal.
